are these the real opium poppies? Where do they come from?
illegal if the pods are scored,scraped or damaged by any means-manmade or natural. there are no "plant police" but you open liability should the damaged pods be observed as the flower is a classified plant -/+ federal and state laws. i had the 'danish flag ' variety planted in south florida, they were wind damaged during hurricane wilma and when FEMA came through, the questioned me along with broward county sherrifs office. no trouble,just remove and destroy remaining plant material.
all poppies EXCEPT "california" varieties produce opium. if the seed says shirly temple or similar or if the poppy has no pod, there is very little chance, if any, that the plant will produce illegal substances. FYI, baking poppy seeds, like those found in poppy seed rolls, bagles ect. come from hungarian varieties, which i think i read that they have closed pods (no opening for the seed to spread freely) on top of the pod. :) i love growing these plants.
