If he was profiting in cash by the sale then YES he would be under law but as of now he is not so your grossly mistaken. Yes it does but it's just the cord no wall plug.

When I last used it it held a charge just fine. I haven't really used it in a while since I have a iPhone. The iPod sits on a radio dock and I just used it when I was in the house.
