@roxyjenkins01 - Your statement is not true. An individual can purchase and use these CDs as HP, Dell, Gateway, Toshiba all sell them to customers to recover their own computers. They do not need to be the original owner of said computer BUT that computer had to be originally installed with that OS or newer.
Believe what you want, and feel free to block me and my comments, but the Microsoft license is very detailed and the large bold print on the front of the disk that says it can only be distributed with a HP PC is part of the license. There are only 2 situations that this disk can be legally transferred:
1) By Dell (or an authorized reseller) to the original purchaser of a Dell system. 2) The original purchaser can give or sell the disk, but only if it is sold along with the original system.
Microsofts statement on this is as follows:
Q. Can my customers transfer or sell their OEM software licenses? A. After an OEM software license has been installed on a PC, the license may not be installed on or transferred to another PC. However, the entire PC may be transferred to another end user along with the software license rights. When transferring the PC to the new end user, the software media, manuals (if applicable), and Certificate of Authenticity label must be included. It is also advisable to include the original purchase invoice or receipt. The original end user cannot keep any copies of the software.
